End-User License Agreement
Unreal Ecosystem is a website that offers assets and courses for artists for their projects. The website, unrealecosystem.com and all its subdomains are owned and operated by Jakub Hałuszczak. This End-User License Agreement ("Agreement", "EULA", "License") applies to all users using the Service.
1. ACCEPTANCE
This EULA is a legal agreement between you and Jakub Hałuszczak. The purpose of this EULA is to enable you to use the Services provided by Jakub Hałuszczak on unrealecosystem.com. This EULA is effective as of the date you first access or otherwise use the Service. By using the Service, you acknowledge that you have read the Privacy Policy and EULA.
BY USING THE SERVICE, YOU AGREE TO THE TERMS OF THIS AGREEMENT AND A LEGALLY BINDING CONTRACT IS FORMED BETWEEN JAKUB HAŁUSZCZAK AND YOU. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICE.
2. THE SERVICE
The Service includes "Assets" and any other downloads from the site. You and third parties are prohibited from using the Unreal Ecosystem Assets or any downloads in any other product or service, or from developing products or services that compete with the Unreal Ecosystem Services.
3. GRANT OF LICENSE
Subject to the terms of this Agreement and your continued compliance, Jakub Hałuszczak grants you a limited, non-exclusive, revocable license that is non-sublicensable and non-transferable to access and use the Service for personal and commercial purposes.
4. LICENSE RESTRICTIONS
4.0 You agree to abide by all applicable laws and regulations in using the Service.
4.1 Assets and any downable files may not be sold, leased, licensed, or otherwise provided to third parties on a “stand-alone” basis.
4.2 You may not without Jakub Hałuszczak's prior written consent bundle, incorporate, distribute, or redistribute Assets or any downable files or with any digital content creation software that is monetized, used to generate revenue, directly or indirectly, or for free by you or any third party.
4.3 Other Restrictions - you agree not to:
rent, lease or transfer the Service, or related software or materials
use the Service for any illegal purpose
use the Service in any manner that breaches the EULA
take any action that imposes an unreasonable or disproportionately large load on the Service or servers etc.
use the Service in any manner which violates the rights of a third party, including without limitation intellectual property rights
5. CONSENT TO USE OF DATA
You agree that Unreal Ecosystem may collect data gathered as part of the support services provided to you. For more information see the Unreal Ecosystem Privacy Policy.
6. IMITATION OF LIABILITY AND REMEDIES
Under no circumstances including negligence (unless otherwise required by applicable law), shall Jakub Hałuszczak (including breach of any warranty hereunder) be liable for any direct, indirect, punitive, special, incidental, or consequential damages that result from your use of Unreal Ecosystem or arising out of or relating to this Agreement, even if any exclusive remedy provided for in this Agreement fails of its essential purpose and even if Unreal Ecosystem or Jakub Hałuszczak has been advised of the possibility of such damages.
7. INDEMNIFICATION
Your use of the Unreal Ecosystem constitutes your agreement to defend, indemnify, and hold harmless Unreal Ecosystem and Jakub Hałuszczak. You agree that Jakub Hałuszczak may seek and shall be entitled to injunctive, equitable, or other similar relief to protect, maintain, defend, enforce, and preserve such rights.
8. MODIFICATION
Jakub Hałuszczak reserves the right, at its discretion, to update or revise the EULA at any time. Jakub Hałuszczak might post major changes in its Unreal Ecosystem Service, and/or its Website, and/or communicate such changes via email or otherwise communicate such terms to you in a suitable manner decided by Jakub Hałuszczak, and these additional or revised terms will become part of the EULA effective immediately. Please check the Unreal Ecosystem Service, the EULA, or the Website periodically for changes. Your continued use of Unreal Ecosystem EULA, including any changes or modifications made by Unreal Ecosystem as permitted above.
9. ENTIRE AGREEMENT
This Agreement does not constitute and shall not be construed as constituting a partnership or joint venture between Jakub Hałuszczak and you. This EULA constitutes the entire agreement between the parties, with respect to this specific subject matter hereof and shall not be modified except as provided in this Agreement.
